Terms of service

These terms govern the use of the Roadby app and of this website (roadby.app). By creating an account or using either of them, you accept what follows.

1. What Roadby is

Roadby is a service that lets drivers talk by voice, live and hands-free, with other people who are physically nearby at that moment. Today it runs on Android only, as a private build that is not published on Google Play: it is shared by hand while the app is being finished. A release on Google Play and, later, on the App Store is planned; an iOS version does not exist yet.

2. Safety at the wheel: the most important part

You are solely responsible for complying at all times with the traffic rules that apply to you, including those on using mobile devices while driving. Roadby is designed to be used hands-free, through your car's Bluetooth kit or your phone's speaker, but setting up your phone, choosing your proximity radius or checking the radar must always be done with the vehicle stopped in a safe place. Never wear headphones or earphones while driving: in Spain this is against the law (Article 13.3 of Spain's Law on Traffic, Circulation of Motor Vehicles and Road Safety, consolidated text approved by Royal Legislative Decree 6/2015), and other countries have similar rules. Roadby is not liable for improper use of your device while driving.

3. Who can use Roadby

[Pending decision] The minimum age for using Roadby, and how it is declared at sign-up, are still to be defined with our legal adviser; today sign-up does not ask for it. This section will be completed before the final version.

You need an account with a valid email address. You are responsible for keeping your password secret and for all activity that takes place from your account.

4. Community guidelines

These rules restate and extend the ones the app shows under Settings › Account › Community guidelines. By using Roadby you agree not to:

• Harass, threaten or intimidate other users.
• Post or express hate speech on grounds of origin, gender, orientation, religion, disability or any other condition.
• Drive recklessly or encourage others to do so.
• Send spam or use Roadby for unauthorised commercial purposes.
• Upload a profile photo with sexually explicit or violent content, or a photo that is not of you.
• Impersonate another person or create fake accounts.

You can block any user at any time, and report behaviour that breaks these rules from their profile in the app (⋯ button › Report @username). We reserve the right to review the reports we receive and, where appropriate, to suspend or close accounts that break these rules.

5. Content you upload

You remain the owner of your profile photo and your bio, but you authorise us to show them inside the app to other users as described in the privacy policy. Profile photos may go through an automatic content filter before they are published (see section A.2 of that policy); we reserve the right to remove any content that breaks these rules.

6. Availability of the service

Roadby is still being built and is not published on any app store: today it is a private build shared by hand with a small number of people. We do not guarantee that the service will be available continuously or free of errors, and we may change, suspend or discontinue any feature at any time.

7. Limitation of liability

Roadby is provided “as is”. To the extent permitted by law, we are not liable for indirect damages arising from use of the app, nor for the behaviour of other users during a voice conversation or any encounter the app makes possible.

8. Closing your account

You can delete your account whenever you want from Settings › Account › Delete account. We may suspend or close accounts that break these terms, especially the community guidelines in section 4.

9. Intellectual property

The name “Roadby”, its brand and the design of the app and of this website belong to the operator of Roadby identified under “Who is responsible” in the privacy policy. Copying, reproducing or using them without permission is not allowed.

10. Changes to these terms

If we make a significant change to these terms, we will update the date shown at the top and, when the change is important, we will also give notice inside the app.

11. Governing law

These terms are governed by Spanish law. Any dispute will be submitted to the courts that apply under consumer protection rules.
